Abstract/Citation: | Governs the protection of employment and all related matters. Part One regulates the termination of employment. Establishes the right of an employer to terminate an employee's employment under certain regulations. Allows for termination without notice during probationary periods. Allows for termination in cases of employee misconduct or failure to perform duties only after making a written warning to the employee. Specifies the content of such notices. Governs the justification for and process for making redundancy dismissals. Specifies that the reason for the termination must be given to the worker. Obliges employers to give preference to former employees when hiring. Allows for immediate termination of employment in cases of serious misconduct by the employee. Part Two provides for a redundancy benefits plan. Obliges employers to pay redudancy benefits and determines the amount of benefits. Establishes when an employee may claim benefits. Part Three establishes a redundancy benefits fund. Creates a redundancy benefits fund committee to govern the fund. Establishes the functions and duties of the committee. Governs applications to the committee for benefits or refunds. Establishes that the minister is ultimately responsible for the fund. Regulates audits and reports of the fund. Part Four governs enforcement. Regulates complaints to an industrial relations tribunal. Establishes the powers of the tribunal with respect to proceedings. Sets penalties for offences. |
