Adopted by referendum 7 August 1996. Chapter III provides for citizenship and naturalization. Chapter IV provides for protection of fundamental rights and freedoms. Sets forth right to life (except in cases of death penalty), right to personal liberty, protection from forced labour (except when ordered by a court), and protection from torture. Also provides for freedom of religion, speech, and association, rights of children, women (equal treatment with men) and the disabled. Art. 34 allows for the declaration of a state of emergency and the derogation of a number of civil rights. Chapter V provides for elections; Chapter VI for the Executive (President, Vice President, Cabinet); Chapter VII for the National Assembly; Chapter VIII for the judiciary, including the Supreme Court (final court of appeal), a Special Criminal Court (crimes regarding public property) and a Cadi Court (Sharia law). Chapter X establishes the office of the Ombudsman, Chapter XI covers the public service; Chapter XII the police force and prison service. Chapter XXI sets forth a Code of Conduct for public officers.
