Abstract/Citation: Extends the scope of duty imposed on an employer to consult elected employee representatives where 20 or more redundancies are proposed. S. 9 provides that a dismissal is unfair if the principal reason for it was the performance by an employee representative of his duties and functions. Made following the judgement of the European Court of Justice in cases C382/92 and C383/92.
