These Regulations revoke and replace the Control of Asbestos at Work Regulations 2002 (CIS 03-1029), and revoke and re-enact, with modifications, the Asbestos (Licensing) Regulations 1983 (CIS 83-1850) and the Asbestos (Prohibitions) Regulations 1992 (CIS 93-359, as amended by CIS 03-1518). They implement in Great Britain the provisions of Directives 76/769/EEC (CIS 92-22), 83/477/EEC (CIS 84-327), 90/394/EEC (CIS 90-1758) and 98/24/EC (CIS 98-1094), as modified. The main purpose of the Regulations is to protect workers who may be exposed to asbestos at work and other persons who may be affected by such work. They also impose duties on employees concerning their own protection from such exposure. The new control limit for all kinds of asbestos is set at 0.1f/cm3 of air averaged over a continuous period of 4h. Contents: interpretation; application; duty to manage asbestos in non-domestic premises; identification of the presence of asbestos; assessment of work which exposes employees to asbestos; plans of work; licencing of work with asbestos; notification of work with asbestos; information, instruction and training of workers; prevention or reduction of exposure to asbestos; use and maintenance of control measures; provision and cleaning of protective clothing; arrangements to deal with accidents, incidents and emergencies; duty to prevent or reduce the spreading of asbestos; cleanliness of premises and plant; designated areas; air monitoring; standards for air testing and site clearance certification; standards for analysis; health records and medical surveillance; washing and changing facilities; storage, distribution and labelling of raw asbestos and asbestos waste; prohibitions (basically, the importation, supply and use of asbestos and of any product to which asbestos has intentionally been added are banned).

Refundición, con modificaciones, del Reglamento de 1987 sobre el mismo tema (CIS 89-1418), modificado en 1992 (CIS 93-360) y 1998 (CIS 00-21). Aplica en Gran Bretaña las Directivas 76/769/CEE (CIS 92-22), 83/477/CEE (CIS 84-327), 90/394/CEE (CIS 90-1758) y 98/24/CE (CIS 98-1094). Asegura la protección de los trabajadores y de otras personas contra el amianto en el lugar de trabajo. Impone a los trabajadores obligaciones sobre su protección frente a dicha sustancia. Se establece un nivel de intervención a: 72 h/mL (aire) para el crisotilo, 48 h/mL (aire) para otros tipos de amianto (mediciones continuas durante 12 semanas). Los valores-umbral correspondientes son: 0,3 f/ml (4h), 0,9f /ml (10min) para el crisotilo; 0,2 f/mL (4h), 0,6 f/mL (10 min) para otros tipos de amianto, sobre la base de mediciones continuas en el atmósfera. En el sumario: interpretación; responsabilidades de empresarios; obligación de gestionar la presencia de amianto en los sitios no domésticos; identificación del tipo de amianto presente en el lugar de trabajo; planes de trabajo; declaración de la presencia de amianto a la autoridad competente; información y formación de los trabajadores; prevención y reducción de la exposición al amianto; utilización y mantenimiento de los medios de prevención; suministro y limpieza de la ropa de protección; planes de emergencia en caso de accidente o incidente; obligación por parte del empresario de impedir la propagación de amianto; limpieza de los locales; zonas de peligro designadas; control de las atmósferas de trabajo; normas relativas a los tests atmosféricos; normas de análisis; registros de salud y control médico; instalaciones sanitarias y vestuarios; almacenamiento, distribución y etiquetado del amianto en bruto y de los residuos que contienen amianto; suministro de amianto para su uso en los lugares de trabajo.

Este Reglamento modifica el reglamento de 1992 que prohíbe la mayoría de las utilizaciones del amianto (ver CIS 93-359) y traspone en la legislación británica las disposiciones de la directiva 1999/77/CE (ver CIS 99-1767). Entre las modificaciones introducidas hemos de citar un cambio en la definición del término "suministro" de amianto, que de ahora en adelante se entenderá con consideraciones distintas a las monetarias. La prohibición de importación, suministro y utilización del amianto se extiende al crisotilo. Se contempla la posibilidad de acordar una derogación por motivos de seguridad nacional. En un anexo: lista de derogaciones a la prohibición de importación; suministro y utilización del crisotilo.

CIS 93-360 Health and Safety - The Control of Asbestos at Work (Amendment) Regulations 1992 [United Kingdom]
These Regulations (entry into force: 1 Jan. 1993) amend the Control of Asbestos at Work Regulations 1987 (see CIS 89-1418), and they implement as respects Great Britain Council Directives 91/382/EEC (see CIS 92-15) and 90/394/EEC (CIS 90-1758). The Regulations redefine the terms action level and control limit. "Action level" is defined as cumulative exposures to asbestos over a continuous 12-week period of 96 fibre-hours/mL of air, when exposure is solely to chrysotile, and 48 fibre-hours/mL of air otherwise. "Control limit" is defined as asbestos concentrations of 0.5 fibres/mL of air (for chrysotile alone) and 0.2 fibres/mL of air when other types of asbestos are present, both averaged over a continuous period of 4h. When averaging is over a continuous period of 10min, the control limit is 3 times the above. The Regulations also make provisions for an obligatory work plan before any work involving the removal of asbestos from buildings or structures, and for emergency action when asbestos escapes into the workplace air at concentrations exceeding the control limit.

CIS 93-359 Health and Safety - The Asbestos (Prohibitions) Regulations 1992 [United Kingdom]
These Regulations (entry into force: 1 Jan. 1993) replace the Asbestos (Prohibitions) Regulations 1985, and they implement as respects Great Britain Commission Directive 91/659/EEC (see CIS 92-19) adapting to technical progress Annex I of Council Directive 76/769/EEC (CIS 92-22). The Regulations prohibit the importation, supply and use of all forms of amphibole asbestos (crocidolite, amosite, and fibrous actinolite, anthophyllite and tremolite), as well as mixtures containing any of these minerals. Asbestos spraying by any person is prohibited. The supply and use of a number of products (listed in the schedule) containing chrysotile is also prohibited.
