This report was prepared as a reference document for a meeting held in Budapest (29-30 October 2009) on labour inspection and undeclared work migration and trafficking in Europe. It highlights some of the labour inspection measures taken in law and practice by the European Union countries and it is based in part on a questionnaire filled out by participants prior to the event, as well as on a series of guidelines prepared and endorsed by the experts, with the hope that they will assist labour inspectorates and policy makers as they work toward developing more effective and better coordinated labour inspection responses to the phenomenon of undeclared work.

A new-generation safety contest in the construction industry - A long-term evaluation of a real-life intervention
A new-generation safety campaign has been taking place in southern Finland since 1997. The Finnish Construction Employers' Association, together with trade unions, safety inspectorates and other institutions have been organising a safety contest based on the standardised TR-observation method. Safety inspectors conduct evaluation visits without previous notice to the sites, and best performing companies and sites are rewarded at annually held public seminars. Even though participation was voluntary, more than 70% of the construction sites in the target area participated in the contest, and the results have been successful. A key success factor may be the adoption among firms of a new, standardised safety monitoring method which has been used effectively by senior management teams. The method employs a combination of penalties and incentives in order to set and enforce new safety targets. Another success factor is the close co-operation between the construction industry, labour organisations and safety authorities.

A few years ago, the Belgian government launched an action plan for the prevention of occupational accidents (the "Pharaon" plan). Since then, the implementation of this plan has been the object of intensive efforts. This article analyses the current situation with respect to the implementation of the action plan. Complaints regarding occupational health and safety in the area of Thessaloniki (Greece)
This paper deals with the complaints regarding occupational safety and health in a region of Greece. It seeks to examine who are the complainers, to which companies or activities they belong, to what extent complaints are relevant to occupational safety and health, and whether the complaints result in penalties. Complaints irrelevant to occupational safety and health are twice as frequent as those that are relevant. In three quarters of the cases, the complaints do not result to any kind of sanction. In one fifth of the cases, the complaints are not followed by any action taken by the office in charge. Implications of these and other findings are discussed.

Evaluation of cancer among occupants of two office buildings
In 2007, the National Institute for Occupational Safety and Health (NIOSH) received a health hazard evaluation (HHE) request from the management of NASA's John Glenn Research Center (NASA GRC in Cleveland, Ohio, regarding on-going employee and union concerns about a possible higher rate of cancer among current and former employees of two buildings, possibly due to potential exposure to jet fuel and de-icing compounds from the nearby airport, asbestos in the buildings, water damage in the buildings, and general indoor environmental quality. A number of investigations were carried out. Findings are discussed. It is concluded that there is no evidence that the cancers reported are associated with work in the buildings because the number and types of cancers do not appear unusual; the different types of cancers do not suggest a common exposure; no significant hazardous exposures were identified and evidence leads to non-occupational causes.

Cananea copper mine - An international effort to improve hazardous working conditions in Mexico
A team of international occupational safety and health professionals evaluated the working conditions and health status of miners at a giant open-pit copper mine in Cananea, Mexico. Workers in the ore processing plants were exposed to levels of crystalline silica 10 times the Mexican regulatory limit, high levels of acid mist and noise, and numerous safety hazards, including unguarded machinery and malfunctioning 10- and 15-ton cranes. Lung function testing and interviews with physicians showed a substantial percentage of miners with adverse respiratory symptoms including shortness of breath (46%), wheezing (12%), coughing (12%) and elevated sputum production (10%). The mine owner, Grupo Mexico, violated Mexican law by failing to conduct an industrial hygiene survey sufficient to identify, evaluate and control health hazards including exposure to mineral dust (including silica), acid mists, airborne solvents, high noise levels, high vibration levels and extreme temperatures.

Local authorities and HSE in partnership: An evaluation
This evaluation of the partnership between the Health and Safety Executive and Local Authorities was carried out during the summer of 2008. The purpose of the evaluation was to enable HSE to take an informed view of the contribution that the partnership can and should make to a new strategy. This report is the output of that evaluation and addressed three main issues: the extent to which the partnership has fulfilled its objectives; whether the benefits of the partnership outweigh the costs; what needs to be done to ensure its long-term health of the partnership. Findings are discussed.

Evaluation of radiation exposure to TSA baggage screeners
In 2002 and 2003, the National Institute for Occupational Safety and Health (NIOSH) received health hazard evaluation (HHE) requests from Transportation Security Administration (TSA) employees at several airports, expressing concerns about a variety of issues including exposure to X-rays from carry-on baggage and checked baggage screening machines. TSA management also submitted a separate request for NIOSH to perform an independent study to determine the levels of radiation emissions from the various TSA screening equipment, and whether routine use of dosimetry is warranted. In May 2003, 12 airports were randomly selected for study. Basic characterizations of work practices, spot measurements for radiation, and employee interviews were completed between 2003 and 2004. Monthly radiation measurements were obtained from personal dosimeters issued to TSA baggage screeners. It was observed that Explosive Detection System (EDS) machines at several airports exhibited a flaw that could be a source of unnecessary radiation exposure to baggage screeners operating these machines. However none of the participants' doses exceeded the Occupational Safety and Health Administration (OSHA) permissible exposure limit. Furthermore, no doses exceeded 25% of the OSHA quarterly limit which would require employee monitoring. Recommendations include taking some defective machines offline and extending the evaluation to a larger number of airports.

Evaluation of exposures at a pottery shop
In 2007, the National Institute for Occupational Safety and Health (NIOSH) received a request for a Health Hazard Evaluation (HHE) from the management of a pottery shop. Although no health symptoms were reported, management was concerned about the potential for employees' long-term exposure to a variety of substances while performing duties at the pottery shop. Exposures of concern included silica from the clay mixing process, elements from mixing dry materials used in the glazes, and volatile organic compounds and gases during kiln firing. Because management requires the use of respirators during clay and glaze mixing, they also requested information on proper respirator use and maintenance. NIOSH staff toured the facility to review work processes, collected personal breathing zone, and area and wipe samples. An ergonomic evaluation of the work processes was also performed. Recommendations include improvements to the ventilation systems, implementing a formal respirator programme, implementing a safety and health training programme, adopting preventive maintenance for the forklift truck and keeping loading dock doors open while using the forklift to prevent the build-up of carbon monoxide.

Report on respiratory and dermal conditions among machine shop workers
In 2007, the National Institute for Occupational Safety and Health (NIOSH) received a confidential Health Hazard Evaluation (HHE) request from workers of a machine shop, reporting recurrent pneumonias, asthma and other respiratory symptoms as well as rashes and skin irritation that they related to the metalworking fluid (MWF). NIOSH investigators conducted telephone interviews with workers, treating physicians, company management and safety officials, and the director of the company's referral occupational health clinic. They reviewed medical records and environmental monitoring conducted by the company. They also conducted microbiological tests on samples of MWF collected from the machine shop. The investigators found that workers' symptoms and diagnoses were consistent with those associated with exposure to MWF. Workers in the machine shop reported not receiving training on the health hazards of MWF and not being provided respiratory protection; furthermore, they are not included in a medical surveillance program. As a result of this investigation, NIOSH made a number of recommendations with respect to training, exposure surveillance, ventilation, and supply of personal protective equipment.

Employers or self-employed persons providing lifting equipment for use at work, or those who have control of the use of lifting equipment, must make sure the lifting equipment is safe. The main requirements for duty holders are in the Provision and Use of Work Equipment Regulations 1998 (PUWER, see CIS 99-1429) and the Lifting Operations and Lifting Equipment Regulations 1998 (LOLER, see CIS 99-1428). This booklet provides advice on the options under LOLER relating to the requirement for thorough examination and inspection of lifting equipment and includes the benefits of having an "examination scheme".

Safety of hydraulic machines: a review of condition-based maintenance strategies

Key conclusions of this literature survey of condition-based maintenance strategies for hydraulic machines: Risks linked to such equipment include leakages causing high pressure jets, projection of mechanical components, as well as sudden and unexpected motions of machine parts. Corrective maintenance usually carried out after machines break down is not necessarily safe. Condition-based maintenance monitors the different parts of the hydraulic system constantly and can be used for early fault detection. It reduces the number and duration of interventions, enables safer and planned maintenance schedules, provides more information on the state of the hydraulic system, improves the reliability of the hydraulic system by reducing the probability of dangerous failures and reduces the risk of accidents. The six methods of condition-based maintenance described and analysed are hydraulic oil analysis, monitoring measurements from the system, vibration analysis, expert systems, artificial neural networks and the extended Kalman filter.

A strategic approach to labour inspection [en inglés]
In a report released in 2006, the ILO highlighted the difficulties of labour inspection in its member States and advocated a number of measures to strengthen its effectiveness. This article argues that inspectorates must go beyond calls for more inspectors by adopting a clear strategic framework for reacting to incoming complaints and targeting programmed investigations in order to maximize effectiveness in the use of their overstretched resources. To do so, it proposes that their work must be guided by the principles of prioritization, deterrence, sustainability and achieving systemic effects. The article concludes with an outline of the requirements of a coherent regulatory strategy.

Examining the role of labour inspection in the context of the revival of labour market regulation, this article distinguishes between the Latin model, where inspectors have authority to tailor enforcement to firms' exigencies, and the less flexible United States approach. The Latin model can reconcile regulation with economic flexibility and transform inspectors into the shock troops of a campaign for decent work. But its vulnerability to arbitrary behaviour on their part needs to be addressed through management of organizational cultures, exposure and systematization of the tacit knowledge underpinning inspectors' judgments and research into the relationship between labour standards and business practices.

When OSHA knocks
This article offers advice to employers on how to react in case of an unannounced OSHA inspection: restrict admittance until management personnel are on site; determine the reason for the inspection; in cases where the inspection is the result of a complaint, insist on being given a copy of the complaint; distinguish whether the inspection is related to safety or industrial hygiene; identify inspections aimed at protecting employees having filed a complaint; designate an employee representative; limit the scope of an inspection if possible; have injury and illness logs ready for review; take the same photographs and videos as the OSHA inspector; have company representatives be present during OSHA interviews and debrief other employees after the interviews; protect trade secrets; remember your right to refuse an inspection without a warrant.

International OHS: Through the looking glass of the global economy
In late 2007, a multinational group of occupational safety and health professionals travelled to Mexico to observe working conditions at a giant open-pit copper mine at the request of a trade union. The conditions were found to be poor. Levels of silica dust were particularly high. Dust collectors had been dismantled. The mine was also visited by Mexican labour inspectors who ordered the employer to implement a series of measures. The next step of this international occupational safety and health project will likely include filing a complaint by trade unions in Mexico and the United States. Efforts also are being made to raise funds for a more comprehensive health study of active and retired miners to determine the prevalence of respiratory diseases such as silicosis.

Overview of the occupational safety and health situation in the Arab region
In an effort to promote safer working conditions in the Arab region, the ILO and the Arab Labour Organization (ALO) held a workshop in Damascus, Syria, on 18-20 November 2007. In preparation for the meting, a questionnaire was addressed to the Ministries of Labour of all participating countries to obtain information on the existing national occupational safety and health conditions. These responses were used to compile this report, which served as a basis for discussion during the workshop. Monitoring risks in association with exposure levels among wastewater treatment plant workers
The objective of this study was to investigate the relationship between exposure to hydrogen sulfide and endotoxins, and health symptoms among wastewater treatment plant (WWTP) workers. The exposure levels for specific tasks were measured by personal monitoring. Data on health symptoms were collected by means of questionnaires. Higher risks of respiratory, ocular and skin irritation, neurological and gastrointestinal symptoms were found among WWTP workers compared with unexposed workers. Tasks related to sludge handling and plant inspection showed statistically significant associations with memory and concentration difficulties, throat irritation and stomach pain.

Evaluation of the mechanical condition of agricultural vehicles
An investigation was undertaken to assess the mechanical condition of agricultural vehicles in use on farms in the United Kingdom. A detailed examination of 242 tractors and 71 agricultural trailed appliances was carried out to meet the requirements of an inspection according to The Provision and Use of Work Equipment Regulations 1998 (PUWER 98, see CIS 99-1429). Experienced agricultural engineers carried out the examinations and analyzed the results on the scale and nature of defects according to vehicle age and horsepower, region and main farm activity. Close to 70% had faults, some minor and easily correctable by replacing light bulbs, others are more major items such as brake performance, tyre wear and pressures and driver vision items (windscreen wipers, external rear view mirrors).

Implementation of the Labour Standards Enforcement Framework in the Philippines
In 2004, the Department of Labour and Employment of the Philippines developed an innovative Labour Standards Enforcement Framework (LSEF) aimed at introducing an alternative mechanism for carrying out labour inspections, bearing in mind the limited number of labour inspectors and the increasing number of establishments that need to be inspected. This document reports on the level of implementation of inspections following the introduction of the LSEF. Although the proportion of establishments being inspected has increased, recommendations are proposed for achieving further improvements.
