Abstract The various issues raised by the need to harmonize OSH legislation across Australia including state-to-state differences in the responsibilities of employers and employees, the interpretation of "reasonable practicability" and the application of the presumption of guilt are discussed, in light of the specific case of a coal mine disaster in New South Wales.
