The ILO comments are provided on the basis of an English translation prepared by the Office of the draft labour code dated 26 September 2011. The Office was informed that this draft text reflected the outcome of the September 2011 consultations of the Government with employers' organizations and trade unions. The ILO is aware that subsequent changes may have been introduced in the draft law as a result of further consultations of the Government with the social partners.
In keeping with the spirit of the Tripartite Consultation (International Labour Standards) Convention, 1976 (No. 144), ratified by Hungary in 1994, the ILO comments were prepared with a view to providing support to the social dialogue process.
The ILO Memorandum mainly provides comments on those provisions for which the Office recommends changes to ensure their full compliance with ratified international labour Conventions. In making these comments, the Office referred to the authoritative jurisprudence of the ILO Supervisory bodies (Committee of Experts on the Application of Conventions and Recommendations and of the ILO Committee on Freedom of Association) which examines how ILO Member States are applying in law and practice ratified International Labour Conventions.
Hungary has ratified a total of 72 ILO Conventions, including the eight (8) core International Labour Conventions covering subjects that are considered as fundamental principles and rights at work: freedom of association and the effective recognition of the right to collective bargaining; the elimination of all forms of forced or compulsory labour; the effective abolition of child labour; and the elimination of discrimination in respect of employment and occupation.
The ILO remains ready to offer any assistance as may be required by its tripartite constituents in Hungary.
